4. Disclaimer of warranty

The organiser points out that the availability and function of the competition cannot be guaranteed. The competition may be terminated or removed due to external circumstances or constraints; this does not entitle participants to raise any claims against the organiser.

Legal recourse is excluded.

5. Liability

The organiser’s liability for damages shall be governed by the following exclusions and limitations of liability, without prejudice to the other statutory conditions of entitlement in accordance with this Clause 5.

The organiser is liable without limitation if the cause of damage is based on intent or gross negligence.

Furthermore, the organiser is liable for the slightly negligent breach of essential obligations whose violation jeopardises the achievement of the purpose of the contract, or for a breach of obligations whose proper execution make the competition possible in the first place and upon the observance of which the contracting party regularly trusts. In this case, however, the organiser is only liable for foreseeable damage that is typical for the contract. The organiser is not liable for the slightly negligent breach of duties other than those mentioned in the above sentences.

The aforementioned limitations of liability shall not apply in the event of injury to life, limb and health, for a defect following acceptance of quality guarantees for the quality of a product and for maliciously concealed defects. Liability under the German Product Liability Act remains unaffected.

Insofar as the liability of the organiser is excluded or limited, this also applies to the personal liability of the organiser’s employees, representatives and vicarious agents.
